Background:
This Act prohibits employers from inquiring into an applicant's compensation history as follows:
- Employers may not screen applicants based on their salary history, including by requiring that an applicant’s past salary satisfy minimum or maximum criteria.
- An employer and an applicant can discuss and negotiate salary expectations so long as the employer does not first request or require the employee to divulge salary history.
- An employer can seek an applicant’s salary history once an offer of employment with terms of compensation has been extended to the applicant and that offer has been accepted.
The effective date of the bill was delayed by 6 months - now 12/14/2017 – to allow employers to update their policies.
