
White Male Candidate Failed To Show That Sheriff's Legitimate Reason For Promoting Black Female Was Pretextual
Granting summary judgment for the defendant in this case, the
United States District
Court held that a white
male candidate failed to show that the sheriff's legitimate reason for promoting
a black female candidate to commander on the basis that she was better qualified
was a pretext for reverse race or sex discrimination. The white candidate
showed, at best, that he and the black candidate had equal qualifications, and
his numerical evidence of eight past promotions over ten years off of six
different eligibility lists presenting a combined pool of 45 candidates did not
establish that it was more likely than not that the cause of the perceived
promotion pattern was intentional discrimination.
