Background and Details of the Change:

The City of Philadelphia has enacted a law that prohibits employers from seeking information about a job applicant’s prior salary. The Philadelphia ordinance does not allow employers "[t]o inquire [“ask”] about a prospective employee’s wage history, require disclosure of wage history, or condition employment or consideration for an interview or employment on disclosure of wage history, or retaliate against a prospective employee for failing to comply with any wage history inquiry …”

General Impact to Employers:

This change follows a trend at the state and municipal levels. Philadelphia is the first city to enact this kind of law; Massachusetts was the first state last year. At least five other states are considering similar laws (CA, NY, VA, OR and WA). It seems likely that more jurisdictions will follow the lead and there is a possibility of a federal law.
